1. General Provisions
This User Agreement governs your conduct as a registered user (either a "Buyer" or a "Seller") on the Platform. By creating an account and listing or purchasing items, you agree to these rules.
2. The Platform's Role
The Company is purely an IT hosting provider and an intermediary. We are not a party to the contracting, fulfillment, or execution of any purchase agreements made between Buyers and Sellers. We do not guarantee the existence, quality, safety, or legality of the items advertised, nor the truth or accuracy of users' content or listings.
3. Seller Obligations
As a Seller, you agree to:
- Provide accurate, current, and complete information regarding the items you list (Vehicles, Spare Parts, Home & Garden, Clothing, Sports, Instruments, Other).
- Clearly state the condition of the item (e.g., New, Used, Damaged).
- Ensure you have the legal right to sell the item.
- Not list counterfeit goods, stolen property, or any items prohibited by Swiss law.
- Honor the commitments made in your listing regarding price, exchange possibilities, and delivery methods.
4. Buyer Obligations
As a Buyer, you agree to:
- Carefully review the listing details, condition, and Seller terms before committing to a purchase.
- Communicate respectfully with Sellers.
- Fulfill payment obligations as agreed upon directly with the Seller.
5. Prohibited Items
Users are strictly prohibited from listing:
- Weapons, firearms, and hazardous materials.
- Illegal drugs, prescription medications, and regulated substances.
- Items that infringe upon third-party intellectual property rights.
- Any other items that violate Swiss federal or cantonal laws.
6. Disputes Between Users
Any disputes arising from a transaction must be resolved directly between the Buyer and the Seller. The Company is not obligated to mediate or resolve such disputes. However, we reserve the right to suspend or terminate the accounts of users who repeatedly violate this User Agreement or engage in fraudulent activities.
7. Fees and Services
Joining the Platform and setting up a basic account is free. We may charge fees for certain premium services (e.g., Featured Listings, Urgent Badges, Corporate Store accounts). All applicable fees will be clearly communicated before you utilize these services.
